Frequently asked questions
How can the CRA collect on my tax debt?
The CRA has powerful tools to collect unpaid tax debt and doesn’t need a court order to use them. They can garnish your wages, freeze your bank accounts, seize assets, and place liens on your property. These actions can significantly disrupt your personal and business finances. If you’ve received warning letters or a legal notice, it’s important to act immediately.
Does the CRA need a court order to garnish wages?
No. The CRA can garnish your wages without going to court. They can issue a garnishment notice directly to your employer, who is then legally required to deduct a portion of your wages and send it to the CRA. This can happen quickly and without warning. Garnishments can be financially draining and difficult to reverse once in place.
If the CRA has a lien on my house, can they take it away?
The CRA has the authority to register a lien against your property if you have unpaid tax debt. While CRA policy generally avoids seizing and selling a taxpayer’s primary residence, it can still place a lien on it, which affects your ability to sell or refinance. For secondary properties, such as cottages or rentals, the CRA may proceed with seizure and sale.
Can CRA collection action be paused?
In many cases, yes. If you file a Notice of Objection for an income tax reassessment, the CRA must pause collections while the dispute is active. This pause does not apply to HST-related objections, where collection may continue even while your case is under review. Regardless of the type of tax debt, we can intervene with CRA collectors to request a hold on enforcement while your dispute or relief application is underway. Acting early improves your chances of avoiding harsh collection measures.
Will the CRA negotiate the tax amount I owe?
The CRA will not reduce the principal amount of your tax debt—it must be paid in full. However, they may agree to payment arrangements based on your financial situation and may consider waiving penalties and interest in exceptional cases through the Taxpayer Relief Program. The key is knowing which programs are available and how to approach them.
The Taxpayer Relief Program can provide relief from penalties and interest for taxpayers who have significant financial hardship, are facing extraordinary circumstances or have suffered due to actions of the CRA.
